In this Privacy Notice, we explain our privacy practice and provide information on the personal information that Xthings Inc., its subsidiaries and affiliates (collectively “Anviz”, “we” or “us”) collect from you, and our use, disclosure, and transfer of that information through its website portals and applications including but not limited to Secu365.com, CrossChex, IntelliSight, Anviz Community Site (community.anviz.com) (collectively “Anviz Applications”) and the rights and choices you have with respect to your personal information. This Privacy Notice applies to personal information that we collect from you when you actively provide it to us through your interactions with us, we automatically collect as you use Anviz Applications or visit our websites and we receive about you from a business partner or another user of our services.
Children Under the Age of 13
Our Website and Applications are not intended for children under 13 years of age. We do not knowingly collect personal information online from children under 13.
Information We Collect About You and How We Collect It
We collect information directly from you and automatically through your use of the Anviz Applications. To the extent permitted by law or with your consent, we may combine all the information that we collect about you from various sources.
Information We Collect from You
We collect personal information you provide to us, including the information you sent us when you register to access the Anviz Applications, populate or update your account information (including your user profile), apply for a job with us or register to our talent management platform, request information from us, contact us, or otherwise use our products and services through the Anviz Applications.
The information we collect varies depending on your interaction with us, and may include, contact details and identifiers such as your name, mailing address, telephone numbers, fax number, and e-mail address, as well as commercial information such as billing address, transaction and payment information (including financial account numbers or credit or debit card numbers), and purchase history. We also collect any other information that you provide to us (e.g., registration information if you register for one of our training programs or subscribe to our My Anviz News newsletter, such as username and password; drawings or design content if you interact with one of our product or specification collaboration applications; information through your participating in discussion forums; or professional or employment-related information such as resume, employment history when you apply for a job with us or register to receive information about career opportunities at Anviz).
We may also collect information from customers or a third party, if not prohibited by law, who may have your implied or specific consent, such as your employer who provides your employment related information to Anviz Applications to use our products or service.
We may also collect the following information:
- Camera setup information or information of your devices to be used with Anviz Applications, products and services
- Environmental data from the Anviz cameras’ sensors, including location, camera orientation, focus and exposure settings, system health status, physical movements associated with tampering, and more
- Other technical information from the device, such as account information, information input during device setup, environmental data, direct adjustments and video and audio data
Information We Collect Through Automatic Data Collection Technologies
When you visit our Anviz Applications, the information that we automatically collect includes, but is not limited to: device and browser type, operating system, search terms and other usage information (including web scrolling, browsing, and click data to determine what webpages are viewed and links are clicked); geolocation, Internet protocol (“IP”) address, the date, time, and length on the Anviz Applications or using our services, and the referring URL, search engine, or the web page that lead you to our Anviz Applications. The legal basis for such processing (EEA, Switzerland and UK only) is where we need the personal information to perform a contract, or our legitimate interest and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect and process the personal information in question or we may process your personal information where we have your consent to do so. You may withdraw your consent at any time as instructed in the communications or in the Applications, or you contact us at the contact information below.
With information we collect through cookies, web beacons, and other technologies when you visit our Anviz Applications or use our related services we refer to the section “Cookies and Similar Tracking Technologies” below.
To the extent permitted by law or with your consent, we may combine this information with other information that we have collected about you, including from our service providers who help us provide services to you. Please see “Cookies and Similar Tracking Technologies” below for more information.
How We Use Your Personal Information
We use your personal information for the following purposes:
- To provide our products and services to you. We use your information to provide our products and services to you; to take, verify, process, and deliver orders.
- Customer service. We use your information for customer service purposes such as for warranty, and technical support, or other similar purposes; to generate, update and report on order status and history; to respond to your inquiries; and for other purposes for which you contact us.
- Communication. We use your information to communicate with you such as responding to requests for assistance, inquiries or complaints. Subject to applicable law, we may communicate with you in a variety of ways, including by postal mail, e-mail, telephone, and/or text message.
- Administration. We use your information for administrative purposes, including to manage our inventory; to help us better understand access to and use of our Anviz Applications; to provide information and reports to investors, prospective partners, service providers, regulators, and others; to implement and maintain security, fraud prevention, and other services designed to protect our customers, users, vendors, us, and the general public; to enforce this Notice, our Terms and other policies.
- Recruitment and talent management. We use your information to administer and assess your application for a position at Anviz.
- Research and development. We use your information for research and development purposes, including to improve our Anviz Applications, services, and customer experience; to understand our customer and user demographics; and for other research and analytical purposes, including sales history analytics.
- Legal compliance. We use your information to comply with applicable legal obligations and assist government and law enforcement agencies or regulators, in order to comply with the law, a judicial proceeding, court order or other legal process, such as in response to a subpoena or other lawful governmental request or where we are otherwise required or authorized by law to do so.
- To protect others and us. We use your information where we believe it is necessary to investigate, prevent or take an action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, or violations of our Terms or this Notice.
- Marketing. We use your information with your consent to the extent required by law, for marketing and promotional purposes, including through e-mail. For example, we may use your information, such as e-mail address, to send news and newsletters, special offers and promotions about products, services or information we think may interest you.
How We Disclose Your Information
We may disclose your personal information, as follows:
- Users of our Anviz Applications. Any information that you post to discussion forums or other public portions of our Anviz Applications, may be available to all other users of our Anviz Applications and may be publicly available upon posting.
- Affiliates and subsidiaries. We may disclose your information to our affiliates or subsidiaries, for the purposes described above under use of personal information. Subject to legal requirements, we may, for example, share your information with one of our U.S. entities for storage purposes.
- Service providers. We may disclose personal information to service providers, contractors or agents to enable them to perform functions on our behalf. These service providers may, for example, help us administer our Anviz Applications or provide informational or marketing content.
- Any third parties as part of business transfers or in connection with, an actual or prospective corporate business transaction, such as a sale, merger, acquisition, joint venture, financing, corporate change, reorganization or insolvency, bankruptcy or receivership.
- Law enforcement agencies, regulatory or governmental bodies, or other third parties in order to respond to legal process, comply with any legal obligation; protect or defend our rights, interests or property or that of third parties; or prevent or investigate wrongdoing in connection with the Website, Applications or our Services; and/or
- Other third parties with your consent.
Cookies and Similar Tracking Technologies
We use cookies, tracking pixels and other tracking mechanisms, to track information about your use of our Anviz Applications and the applications and services available through our Anviz Applications.
Cookies. A cookie is a text-only string of information that a website transfers to the cookie file of the browser on a computer’s hard disk so that it can remember the user and store information. A cookie will typically contain the name of the domain from which the cookie has come, the ‘lifetime’ of the cookie, and a value, usually a randomly generated unique number. This helps us to provide you with a good experience when you browse our Anviz Applications and to improve our Anviz Applications, products and services. We predominantly use cookies for the following purposes:
- Where they are essential to make our Anviz Applications work. The legal basis for the use of these Cookies is our legitimate interest in ensuring that our Anviz Applications are set up in a way that provides basic functions for our users. This helps us to promote our Anviz Applications and to remain competitive.
- To compile anonymous, aggregated statistics that help us to understand how users use our Anviz Applications and websites, and to help us improve the structure and functioning of our Anviz Applications and websites.
Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies, which are embedded invisibly on web pages. We may use clear GIFs (also known as web beacons, web bugs or pixel tags) in connection with our Anviz Applications and websites to track the activities of users of our Anviz Applications, help us manage content, and compile statistics about usage of our Anviz Applications and websites. We may also use clear GIFs in HTML e-mails to our users, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.
Third-party analytics. We use automated devices and applications to evaluate usage of our Anviz Applications and services. We use these tools to help us improve our services, performance and user experiences. These devices and applications may use cookies and other tracking technologies to perform their services.
Third-Party Links
Our Anviz Applications may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Notice but instead is governed by the privacy policies of those third-party websites. We are not responsible for the privacy, security and information practices of such third-party websites.
International Transfers of Personal Information
We may use, disclose, process, transfer or store personal information outside the country in which it was collected, such as to the United States and other countries, which may not guarantee the same level of protection for personal information as the country in which you reside.
Additionally, there are situations when personal information is transmitted to third-party service providers (in the United States and/or other countries, including countries in which Anviz operates or has offices) to provide services for Anviz, such as payment processing and web hosting and other services required by law. Anviz uses third-party service providers to process personal information for service-related and administrative purposes. Such service providers are located in the United States and other locations where they provide their service. When Anviz retains another company to perform a function of this nature, such third party will be required to protect the personal information and will not be authorized to use the personal information for any other purpose.
The third-party service providers are likely to be located in Australia, Austria, Belgium, Canada, Chile, China, Colombia, Denmark, France, Germany, Hong Kong, India, Ireland, Italy, Malaysia, Mexico, Netherlands, New Zealand, Panama, Poland, Singapore, South Korea, Spain, Sweden, Switzerland, Turkey, UAE, the United Kingdom and the United States.
With regard to residents in the EU and the UK: your personal information will only be transmitted outside the EU or the European Economic Area or UK if the other conditions for such transmission under the GDPR are fulfilled (e.g., signing of EU standard contractual clauses with the service provider(s) pursuant to Art. 46 (2) (c) GDPR).
How We Protect Your Personal Information
All users' Biometric data, whether fingerprint images or face images, are encoded and encrypted by Anviz's unique Bionano algorithm and stored as a set of irreversible character data , and cannot be used or restored by any individual or organization. We have implemented reasonable measures to protect the personal information we collect from damage, misuse, interference, loss, alteration, destruction, unauthorized or accidental use, modification, disclosure, access or processing, and other unlawful forms of processing data. However, please be aware no data security measures can guarantee 100% security. While we monitor and maintain the security of the Anviz Applications, we do not guarantee that the Anviz Applications or any products or services are impervious to attack or that any use of the Anviz Applications or any products or services will be uninterrupted or secure.
How Long We Retain Your Personal Information
We will retain your personal information for no longer than necessary to fulfill the purpose for which the information was originally collected unless a longer retention period is required or permitted by law for legal, tax or regulatory reasons or other legitimate and lawful business purposes. Personal information collected for recruitment purposes will be retained for a reasonable period of time in accordance with applicable law, unless you are hired in which case some of this information will be retained in your employment record.
Your Privacy Rights and Choices
- Your rights. Depending on your jurisdiction, you may request to know whether Anviz holds personal information about you and to access personal information that Anviz holds about you; request that we restrict the use of your personal information or stop using or disclosing your personal information for certain purposes; request that we update, amend, or delete your personal information; object to the occurrence of any result that is to your detriment by means of analysis of personal information exclusively through automated systems; request a downloadable copy of your personal information; request Anviz to stop sharing your personal information for the purpose of cross-context behavioral advertising or targeted advertising. If you have consented to our use of personal information for a specific purpose, you have the right to withdraw your consent at any time. Withdrawing your consent may mean your access to the Applications will be limited or suspended, and your accounts may be terminated as applicable. You may make such requests by contacting us at privacy@anviz.com. Once we receive your request, we will contact you to verify your request. You may be entitled, in accordance with applicable law, to submit a request through an authorized agent. To designate an authorized agent to exercise your rights and choices on your behalf, please e-mail privacy@anviz.com. Anviz will respond to your requests within an amount of time prescribed under applicable law unless we notify you otherwise in writing. You also have the right to lodge a complaint about Anviz’s practices with respect to your personal information with a supervisory authority. If you are a Colorado resident, you may have the right to appeal Anviz’s denial of your privacy rights request.
- Opting into marketing communications. We may ask you to opt-in to receive marketing communications if your opt-in consent is required under applicable law. If your opt-in consent is not required under applicable law, we will not seek your opt-in consent, but you will have the right to opt-out as set forth below.
- Opting out of marketing communications. We may send you promotional e-mail messages if you request to receive information from us. You may request to stop receiving promotional e-mail messages by following the link contained in the e-mail itself. Please note that if you opt out of receiving e-mail marketing communications from us, we may continue to communicate with you for other purposes (e.g., to respond to your enquiries or for service-related purposes). You may otherwise opt out of receiving marketing communications from us by contacting us at the mailing addresses set forth in the "Contact Us" section below.
Updates to This Notice
We may update this Notice periodically to describe new products, processes, or changes to our practices. If we make changes to our Notice, we will post those changes on this page in addition to updating the "Last Updated" or effective date at the top of this webpage. If we make material changes, we will notify you either by emailing you or by posting a notice of such changes prominently on this page prior to such material changes taking effect.
